People Speak End User License Agreement (EULA)

IMPORTANT - READ CAREFULLY: This End User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and People Speak ("Licensor," "we," "us," or "our") for the People Speak add-on (the "Add-on"). By installing, accessing, or using People Speak, you agree to be bound by the terms of this EULA. If you do not agree to all of the terms of this EULA, access, or use People Speak.


1. Grant of License
  • 1.1 Free Tier: Subject to your compliance with the terms of this EULA, Licensor grants you a limited, non-exclusive, non-transferable, revocable license to use the free tier of People Speak solely for your personal or internal business purposes. The free tier may have limitations on features, usage, or output.
  • 1.2 Paid Tier: Upon payment of the applicable subscription fees and subject to your continued compliance with the terms of this EULA, Licensor grants you a limited, non-exclusive, non-transferable, revocable license to use the paid tier of People Speak solely for your personal or internal business purposes. The paid tier will provide access to enhanced features, increased usage, or other benefits as described at the time of purchase.

2. Description of the People Speak Add-on

People Speak is a tool that utilizes OpenAI’s o3-mini model to translate copywriting for specific audiences. The People Speak may offer different features and functionalities depending on whether you are using the free or paid tier.


3. Subscription and Payment (for Paid Tier)
  • 3.1 Subscription Fees: Use of the paid tier of People Speak requires a subscription. You agree to pay the subscription fees as set forth at the time of purchase. All fees are non-refundable except as expressly stated in our refund policy (if any).
  • 3.2 Payment Method: You will provide us with valid payment information and authorize us to charge the applicable subscription fees to your chosen payment method on a recurring basis (e.g., monthly or annually).
  • 3.3 Automatic Renewal: Your subscription will automatically renew at the end of each subscription period unless you cancel it before the renewal date. You are responsible for managing your subscription and ensuring timely cancellation if you do not wish to renew.
  • 3.4 Changes to Fees: We reserve the right to change our subscription fees at any time. We will provide you with reasonable notice of any changes to fees. Your continued use of the paid tier after the fee change goes into effect constitutes your agreement to the new fees.
4. OpenAI Model Usage
  • 4.1 Third-Party Service: You acknowledge and agree that People Speak utilizes OpenAI o3-mini model, which is a third-party service. Your use of the Add-on is subject to any applicable terms of service and privacy policies of OpenAI.
  • 4.2 Data Usage by OpenAI: You understand that when you use People Speak to translate text, your input text will be processed by OpenAI. We are not responsible for the data handling practices of OpenAI. We encourage you to review OpenAI's terms and policies.
  • 4.3 Limitations of AI: You acknowledge that AI translation models are not perfect and may produce inaccurate or inappropriate translations. We do not guarantee the accuracy, completeness, or suitability of the translations provided by People Speak.

5. Restrictions on Use

You agree not to:

  • 5.1. Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of People Speak, except to the extent expressly permitted by applicable law. 5.2. Modify, adapt, translate, or create derivative works based on People Speak. 5.3. Distribute, sublicense, rent, lease, lend, or transfer People Speak to any third party, except as expressly permitted by the license granted herein. 5.4. Use People Speak for any illegal, harmful, or unauthorized purpose. 5.5. Remove, alter, or obscure any copyright, trademark, or other proprietary notices contained in the Add-on. 5.6. Use People Speak in a way that violates the terms of service or acceptable use policies of Adobe Express or OpenAI. 5.7. Circumvent any technological measures designed to control access to or use of People Speak. 5.8. Use People Speak to generate translations that are defamatory, obscene, harassing, or otherwise objectionable.

6. Intellectual Property Rights

People Speak, including all associated software, code, documentation, and other content, is owned by Licensor and is protected by copyright, trademark, and other intellectual property laws. This EULA does not grant you any ownership rights in People Speak.


7. Disclaimer of Warranties

PEOPLE SPEAK IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LICENSOR DOES NOT WARRANT THAT PEOPLE SPEAK WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU ACKNOWLEDGE THAT THE USE OF PEOPLE SPEAK AND THE TRANSLATIONS PROVIDED ARE AT YOUR SOLE RISK.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE PEOPLE SPEAK, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL LICENSOR'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THIS EULA OR PEOPLE SPEAK EXCEED THE AMOUNT YOU PAID FOR PEOPLE SPEAK (IF ANY).

9. Indemnification

You agree to indemnify, defend, and hold harmless Licensor, its affiliates, officers, directors, employees, agents, licensors, and service providers (collectively, the "Indemnified Parties") from and against any and all claims, demands, actions, suits, proceedings, losses, damages, liabilities, costs, and expenses (including, without limitation, reasonable attorneys' fees) arising out of or relating to:

  • (a) Your use of People Speak, including but not limited to any content you create or translate using People Speak.
  • (b) Your violation of this EULA.
  • (c) Your violation of any applicable law, regulation, or third-party rights, including but not limited to intellectual property rights, privacy rights, or rights of publicity.
  • (d) Any claim that the content you create or translate using People Speak is defamatory, libelous, slanderous, obscene, pornographic, or otherwise objectionable.
  • (e) Your misuse of the LLM integrated within People Speak, including but not limited to violations of OpenAI's terms of service or acceptable use policies.

Licensor reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with Licensor in asserting any available defenses. You agree not to settle any matter subject to indemnification by you without the prior written consent of Licensor.


10. Termination
  • 10.1 Termination by You: You may terminate this EULA at any time by ceasing to use People Speak. If you have a paid subscription, you will need to cancel your subscription according to the terms of Section 3.3.
  • 10.2 Termination by Licensor: Licensor may terminate this EULA immediately, with or without notice, if you breach any provision of this EULA.
  • 10.3 Effect of Termination: Upon termination of this EULA, all licenses granted to you will immediately cease, and you must immediately cease all use of People Speak.

11. Governing Law

This EULA shall be governed by and construed in accordance with the laws of the state of California excluding its conflict of law principles.

12. Entire Agreement

This EULA constitutes the entire agreement between you and Licensor with respect to People Speak and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between you and Licensor.


13. Updates to this EULA

We reserve the right to modify this EULA at any time. We will notify you of any material changes by posting the updated EULA within People Speak or by other reasonable means. Your continued use of People Speak after the effective date of the revised EULA constitutes your acceptance of the changes.
